Definitions
Account means an account created by the registration of any real person to the RunForNature Platform.
Activity Points means the points accumulated by Members, through RunForNature’s collection of running data from the Member’s nominated running App.
Member means any person who registers onto the RunForNature Platforms.
Offer means a promotional offer advertised on the RunForNature Platform that may be redeemed with the Member’s Activity Points.
Partner means any third party with whom RunForNature Sdn. Bhd. has an agreement to advertise offers on the RunForNature Platform.
Personal Information means any information collected by Run For Nature Sdn. Bhd. in the process of providing Members RunForNature platform’s services. This may include, but is not limited to, the Members name, email address and running data.
RunForNature Platform means the website available at www.RunForNature.com and the corresponding mobile applications (both IOS and Android), namely RunForNature.
Run For Nature Sdn. Bhd. means the company registered (Run For Nature Sdn. Bhd. – No. Pendaftaran: 1439630-P) operating RunForNature Platform.
Individuals who join RunForNature and/or redeem Offers agree to be legally bound by the Terms and Conditions.
Membership
A Member of the RunForNature Platform must be a natural person.
If a Member is under the age of 18 at the date of registration onto the RunForNature platform, their registration confirms that they have the consent of their parent/guardian.
Members may register by using their email address and creating a password with at least six (6) characters, this will give the Member access to their Account.
Members may register via their personal Facebook account. In this case, the Member authorises Run For Nature Sdn. Bhd. to collect information from their Facebook account. This information is will be collected and used in accordance with Run For Nature Sdn. Bhd.’s Privacy Policy.
Free Nature of the Platform
The services provided by RunForNature are provided to Members free of charge.
Members have no obligation to purchase any product/service advertised on the RunForNature platform.
Activity Points
Members may accumulate Activity Points by monitoring their sporting activities through the use of one of Run For Nature Sdn. Bhd.’s partner Apps.
Members may accumulate Activity Points by referring friends or acquaintances to the RunForNature Platform, if those friends or acquaintances register to the platform.
Members may accumulate Activity Points by sharing the Offers they have redeemed through RunForNature, on social networks.
Members may accumulate Activity Points by using a promotional code provided by RunForNature, or a Partner.
Validity of Activity Points
Activity Points are available for redemption at any time.
Redeeming Offers with Activity Points
Members can use their valid Activity Points to redeem Offers advertised on the RunForNature Platform.
Advertised Offers will include information on the product/service including; description of the Offer, the Partner providing the Offer, the number of Activity Points required for redemption of the Offer, any specific conditions related to the Offer and/or its redemption.
Activity Points are deemed redeemed when the Member clicks on the ‘Redeem’ button on the relevant Offer’s page on the RunForNature Platform.
In redeeming Activity Points, the Member is held to have been aware of the Offer’s particulars, and has consented to redeeming the described Offer.
General Use of Activity Points
Activity Points may only be used to redeem Offers available on the RunForNature platform.
Activity Points may not be used to redeem Offers that have expired, or Offers that may be available in the future.
Activity Points cannot be sold, transferred or assigned and are not redeemable for cash or any other like instruments, including (but not limited to) gift vouchers, gift card, cheques and credit notes.
Refunds and Returns
RunForNature Sdn. Bhd. takes no responsibility if for any reason a Member is not satisfied with an Offer redeemed through RunForNature. Any complaints or concerns about an Offer must be communicated directly with the Partner that provided the Offer.
If a Member believes that there is something wrong with the Offer redeemed, a replacement product/experience will be offered under the Terms and Conditions of the relevant third party Partner.
If the relevant third party Partner that provided the Offer has deemed it appropriate to refund a Member’s Activity Points, the relevant Partner will request a refund of Activity Points from RunForNature Sdn. Bhd. Whether these points are refunded is at the complete discretion of RunForNature Sdn. Bhd., RunForNature Sdn. Bhd. will not refund Activity
Points merely because a Member has changed their mind about the relevant Offer.
In the event that RunForNature Sdn. Bhd. refuses to refund Activity Points, the Member will remain entitled to the Offer that was originally redeemed.
Termination of Account
A Member can terminate their RunForNature Account at any time by sending an email to admin@RunForNature.global.
Termination of an Account may take up to seven (7) working days to be finalised.
Upon termination of an Account, the Member will lose all accumulated Activity Points, and will not be able to have access to these Activity Points by registering again with RunForNature.
Variation
The Terms and Conditions may be modified at any time without prior notification by RunForNature in its absolute discretion. Despite anything to the contrary contained in this document, any modification to the Terms and Conditions may be applied to a Member retrospectively.
Liability
Run For Nature Sdn. Bhd. will not accept any liability for any email communication to any Member that is misdirected, lost or not received.
Run For Nature Sdn. Bhd. will not be liable for any tax liability incurred by a Member in connection with Run For Nature Sdn. Bhd., including that incurred in the provision of redeeming Offers.
Privacy
Run For Nature Sdn. Bhd. may collect Personal Information from Members for the purpose of facilitating the RunForNature Platform and purpose. Please see our Privacy Policy for more information.
Privacy Policy
1. The privacy of your Personal Information is important to us. All Members’ Personal Information will be handled in accordance with our Privacy Policy.
2. We are required to collect your Personal Information in order to process your Account and to communicate with you about your Account. If we cannot collect from you the minimum amount of Personal Information required, we will not be able to process your membership, and your registration may not be accepted.
3. Where you provide any Personal Information to us about any other person in connection with your membership, you confirm that you have the consent of such other person to provide their Personal Information to us and they consent to the handling by us of their Personal Information on the basis of our Privacy Policy.
Passwords
4. Members acknowledge that their email and password give access to their RunForNature Account, including all Personal Information recorded in the Account. Any person in possession of the Member’s email and password may access and change the Member’s Account. By sharing their email and password with any person, the Member agrees that RunForNature may share the Member’s Personal Information with that person and update the Member’s Personal Information in accordance with instructions received from that person.
5. If a Member forgets their password, they can visit the RunForNature Platform and request an email be sent to their email account, containing a link to reset their password.
When do we collect information about you?
6. At times, we are required to collect personal information in the normal course of providing services to our customers.
7. Also, we make use of “cookies” on our platforms. A cookie is a small software message sent to your web browser by our web server. Your browser stores the message in a file and the message is then sent back to our servers each time your browser requests a page from our servers.
8. We use cookies to gain statistics on which areas of our sites attract traffic. We also use cookies to improve your experience of our websites. For example, cookies allow us to recognise whether or not you are returning to our websites. In addition, we make use of third parties who use cookies to serve ads based on past visits to our website. This may allow us to alert you to products or offers which we think you might be interested in viewing.
9. Most Internet browsers are set up to accept cookies. If you do not wish to receive cookies, you will need to adjust the settings of your browser to refuse all cookies or to notify you each time a cookie is sent to your computer.
10. When you click on links and banners on our sites that take you to third-party websites, you will be subject to that third-party’s privacy policies. While we support the protection of privacy on the internet, we cannot be held responsible for the actions of any third-party websites.
What information do we collect?
11. We may collect the following information from you:
a) Your name and contact details, such as your physical address, email address and phone number;
b) Your gender, birthdate and occupation;
c) Your company name (if applicable);
d) The name of the domain from which you access the internet;
e) The date and time you access our sites;
f) Your running statistics and data;
g) The internet address of the website from which you linked directly to our sites; and
h) Other information you may supply to us.
Why do we collect this information?
12. We use the information to customise our services and plan product development so that we can provide you with relevant consumer information and notify you of products and special offers that may be of interest to you across RunForNature and any of our Partners.
13. We use your running statistics and data to transform them into Activity Points that can be redeemed on the RunForNature Platform.
Do we share personal information with third parties?
14. We may disclose information we hold to our directors, officers, employees and other associated companies for business purposes and marketing or remarketing purposes through our websites or other social media channels. Some of our associated companies with whom we share personal information may be located overseas.
15. We may also disclose information to third party service providers or contractors. The countries this information may be disclosed to will vary from time to time, but may include Malaysia and India.
16. Sometimes we use third party platforms and services to process sales, store and analyse data and information, provide web support, send marketing messages, deliver products or otherwise deliver information. These services are hosted and managed by organisations other than ourselves, and some of these services are hosted overseas. We use products and services maintained in Malaysia and India.
17. Your personal information may be stored in a secured and encrypted form overseas (e.g. in data storage and cloud computing facilities operated by us (or by third parties on our behalf)).
18. Where applicable information is shared with these third parties, they are obliged to observe the confidential nature of such information and are prohibited from using any or all of this information other than for the purpose for which it was provided.
19. We will disclose information to a law enforcement agency if we are requested to do so by that agency in relation to suspected unlawful activity.
20. By redeeming Offers that involve RunForNature’s Partners, members agree that RunForNature Sdn. Bhd. may provide the Member’s Personal Information to the relevant third party in order to fulfill the request and related purposes.
Personal information access
21. You may review, change or delete Personal Information related to your use of our website. To access your information, simply sign into your account, click on your name on the top navigational menu and select “edit my profile” – this will take you to “My Profile”. If you would like to know what information we hold about you please contact our Privacy Manager via the details set out at the bottom of this page.
22. If you discover that there is an error or information is missing, please update your details online by signing on and visiting “Edit my profile” and editing the relevant details.
23. We will try to ensure that all information we collect, use or disclose about you in accordance with this Privacy Policy is accurate, complete and up-to-date. We expect that you will promptly notify us of any changes to your personal information.
Anonymity
24. You have the option of using a pseudonym when dealing with us so as not to identify yourself fully to us. Please bear in mind, however, that we will be unable to provide certain services to you unless you disclose your correct identity.
General
25. By using our website and app, you are consenting to the collection of information by us in accordance with this Privacy Policy. Please note that we reserve our right to amend, remove or vary this policy without notice. You should check this page regularly to take notice of any changes we may have made to this policy.
Privacy complaints
26. If you believe that we have breached your privacy rights in any way, or you would like to discuss any issues about our privacy policy please contact us at admin@RunForNature.global
27. All such enquiries or complaints will be taken seriously and handled with impartiality and discretion.
28. If you wish to submit a complaint, please provide us with all relevant details such as the date and time of the incident or communication, the circumstances surrounding the event and your concerns about what was said or done. You will also receive an acknowledgment from us within 7 days confirming receipt of your complaint.
29. Once you have submitted your complaint we will assess it to determine whether or not you have complained about a privacy issue which is covered by the relevant privacy laws. If you have complained about something which is not appropriately dealt with under privacy law, we will write to you and explain why our Privacy Manager is unable to address your complaint.
30. If you have complained about something which the relevant privacy laws cover, we will thoroughly investigate all aspects of your complaint including ascertaining the relevant facts and what your expectations are for any resolution. During our investigation, we may need to seek further information from you as to the nature of or factual circumstances surrounding your complaint.
31. We will endeavour to respond to you at all times promptly and to offer a practical solution that is consistent with our legal obligations.
Offers
Run For Nature Sdn. Bhd. reserves the right to withdraw, cancel or vary the Offers without notice and at any time.
Offers can only be redeemed in Malaysia.
Run For Nature Sdn. Bhd. reserves the right in its absolute discretion to exclude certain Offers and promotions from being redeemed by using Activity Points.
If a Membership is terminated from Run For Nature Sdn. Bhd., all outstanding and future Offers will no longer be valid and will be rendered null and void.
Activity Points can take up to 24 hours after a run before they are available for redemption.
All Offers have an expiry date at which point they will no longer be available for redemption.
Run For Nature Sdn. Bhd. reserves the right to change the expiry date of any Offer at any time without prior notice.
Run For Nature Sdn. Bhd. will not be held responsible or liable if Offers cannot be redeemed for whatever reason.
Certain Offers can only be redeemed once. If this is the case it will be indicated on the Offer page on the RunForNature Platform. If you try to redeem one of these Offers more than once this will be later declined and our customer support team will be in contact with you.
Consent to Receive Direct Marking and Other Marketing Communications
The Member consents to receiving marketing and promotional communications and material from Run For Nature Sdn. Bhd. by email, text message (or other digital service), phone or post, subject to the Privacy Policy and obligations under applicable law.
Contact Between RunForNature Sdn. Bhd. and Members
Where Run For Nature Sdn. Bhd. must give a Member notice of anything concerning RunForNature, Run For Nature Sdn. Bhd. will be taken to have given the Member that notice if Run For Nature Sdn. Bhd.:
a) gives that notice in any way permitted by the Terms and Conditions; or
b) sends the Member an email communication to any email address specified in the Member’s Account, whether or not the email address specified in the Member’s Account is up to date. Members will be responsible if they do not receive a communication from Run For Nature Sdn. Bhd. because the Member’s Personal Information is not up to date.
Run For Nature Sdn. Bhd. and Members agree that email will satisfy any requirement for written communication.
Any electronic communication Run For Nature Sdn. Bhd. sends to a Member will be taken to be received by the Member on the working day after Run For Nature Sdn. Bhd. sends it to the email address specified in the Member’s Account.
Any electronic communication a Member sends to Run For Nature Sdn. Bhd. will be taken to be received on the working day after the Member sends it through the on-line feedback form available at the RunForNature Platform or to the email address specified in the Terms and Conditions for that type of communication.
Miscellaneous
In its absolute discretion, Run For Nature Sdn. Bhd. reserves the right to cancel, terminate, modify or suspend the RunForNature Platform at any time.
The Terms and Conditions are to be read in conjunction with any additional conditions associated with Offers. In the event of any discrepancies, Run For Nature Sdn. Bhd.’s decision in its absolute discretion will be final and binding.
Run For Nature Sdn. Bhd.’s decision in relation to all matters arising in relation to Run For Nature Sdn. Bhd. is final and binding.
Run For Nature Sdn. Bhd. has the right to in its absolute discretion terminate the Account of a Member.
Governing Law
These Terms and Conditions are governed by the Malaysian law and shall be subject to the exclusive jurisdiction of the Malaysian Courts. The parties submit to the non-exclusive jurisdiction of its courts and courts of appeal from them. The parties will not object to the exercise of jurisdiction by those courts on any basis. The governing law will apply irrespective of where the Member completes their application for Run For Nature Sdn. Bhd. and where the Member submits that application.
Challenges Terms and Conditions
When the selection of a winner requires a game of chance (physical or virtual lucky draw or equivalent), the following conditions apply:
1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
2. The Promotion is a game of chance. A winner who has met the selection criteria will be selected at random.
3. Entry is open to all residents of Malaysia who are 18 years of age or over. However, employees and their immediate families of Run For Nature Sdn. Bhd. and their associated agencies and companies are not eligible to enter.
4. The competition will be advertised on Run For Nature Sdn. Bhd.’s social media channels and the RunForNature platform.
5. To enter, participants must enrol in the relevant challenge and complete the challenge’s physical requirements.
6. The random prize draw will take place after the deadline of each challenges. Winners will receive prizes of varying value based on the specifics of each week’s competition, with the total annual competition prize pool value not exceeding RM100,000.
7. Entrants may only enter each weekly challenge once.
8. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill or store receipt for purchase requirement) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
9. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
10. Prizes cannot be transferred and cannot be redeemed for cash.
11. Unless expressly stated, all costs and expenses associated with taking the Prize are the responsibility of the Prize Winner.
12. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner.
13. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value.
14. The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
15. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
16. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
17. Prize values are based upon the recommended retail prices at the time of printing. The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
18. The judge’s decision is final and the promoter will not enter into correspondence regarding the Competition result.
19. Prizes will be awarded to the person named in the entry. However, in a dispute, the prize will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or land line account holder).
20. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
21. All reasonable attempts will be made to contact the Winner. If a prize remains unclaimed by a winner or unallocated or forfeited for any reason for more than 48 hours after the prize is drawn, the prize will be re-drawn excluding the entrant that has failed to claim the prize. This Unclaimed Prize Determination will take place 72 hours after the original draw. If the secondary prize remains unclaimed after a redraw, no further redraws will take place.
22. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
23. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
24. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions.
25. The Promoter and the prize supplier shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter and the prize supplier are not responsible for any incorrect or inaccurate information, either caused by the user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
26. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
27. RunForNature Sdn. Bhd., and their associated agencies and companies and the prize supplier assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
28. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition.
29. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent.
30. The Promoter will not share your personal information with other organisations unless:
a. You give us your express consent
b. Sharing is otherwise required or permitted by law
c. This is necessary on a temporary basis to enable our contractors to perform specific functions.
